Dial Settles with Vi-Jon in Dial Complete Suit
Scottsdale, Ariz., February 20, 2007 -- The Dial Corporation, a company of Henkel KGaA, settled a false advertising and trade dress infringement lawsuit filed in August 2006 against Vi-Jon Laboratories, a leading private label manufacturer of personal care products.
The results of standard clinical hand wash tests conducted for Dial at an independent laboratory showed that the Vi-Jon product, which is positioned as a Dial Complete generic, is "less than one tenth as effective in killing germs" as the superior performing Dial Complete® antibacterial soap product.
Other tests revealed that the Vi-Jon hand soap products contained significantly lower bio-available levels of the active ingredient, triclosan, than the Dial Complete product. The Dial product is uniquely formulated and patented throughout the world.
Vi-Jon is no longer distributing a foaming hand soap product that contains the claim "compare to" Dial's antibacterial foaming hand soap. Additionally, the St. Louis, Mo manufacturer will not make efficacy or "compare to Dial Complete" claims without specific testing to support these claims. ViJon removed the product advertising claim from its products without admitting liability, fault, or wrongdoing. Other terms of the settlement agreement are confidential.
